1. Your Acceptance

By using and visiting this website (collectively, including all Content available through the MybrumTV.com domain name, the "Site"), you signify your consent to these terms and conditions (the "Terms and Conditions ") and the terms of MybrumTV ’s Privacy Policy , which is published at www.mybrumtv.co.uk/articles/privacypolicy/ and which are incorporated herein by reference. If you do not agree to any of these terms, then please do not use the Site.You warrant that you are either more than 18 years of age or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, representations, and warranties set forth in these Terms and Conditions, and to abide by and comply with the same.

2. MybrumTV Site

These Terms and Conditions apply to all users of the Site. The Site contains video footage produced and/or owned by third party public sector organizations (“Footage”) as well as links to third party websites that are not owned or controlled by MybrumTV. We have no control over, and assume no responsibility for the Footage or the content, privacy policies, or practices of any third party websites. In addition, MybrumTV will not and cannot censor or edit the Footage or the content of any third-party site. By using the Site, you expressly relieve MybrumTV from any and all liability arising from your use of any Footage or any third-party website.

3. Site Access

3.1 MybrumTV grants you permission to use the Site as set forth in these Terms and Conditions, provided that: (i) your use of the Site and the Footage is solely for your personal use; (ii) you will not copy or distribute any part of the Site or the Footage in any way without MybrumTV's prior written consent; (iii) you will not alter any part of the Site or the Footage other than as may be reasonably necessary to use the Site for its intended purpose; and (iv) you will otherwise comply with these Terms and Conditions.

3.2 In order to access some features of the Site, you will have to create an account. You may not use another's account without permission. When creating your account, you must provide accurate and complete information and you are solely responsible for the activity that occurs on your account. You must keep your account password secure and notify MybrumTV of any breach of security.

3.3 You agree not to use or launch any automated system that accesses the Site in a manner that sends more request messages to the MybrumTV servers in any period of time than a human can reasonably produce in the same period by using a convention on-line web browser. Notwithstanding the foregoing, MybrumTV grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. You agree not to collect or harvest any personally identifiable information, including account names, from the Site, nor to use the communication systems provided by the Site for any commercial solicitation purposes.

4. Intellectual Property Rights

The content on the Site, including without limitation, the Footage, links to Footage, the text, software, music, videos, interactive features, scripts, graphics, photos, sounds and the like ("Content") and the trademarks and logos contained therein ("Marks"), are owned by or licensed to MybrumTV, subject to copyright and other intellectual property rights under English and foreign laws and international conventions. Content on the Site is provided to you for your information and personal and educational use only and may not be used, copied, reproduced, distributed, broadcast, displayed, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. MybrumTV reserves all rights not expressly granted in and to the Site and the Content. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of any Footage obtained through the Site for any commercial purposes. If you download or print a copy of any of the Content for personal use, you must ensure that all copyright and other proprietary notices contained therein remain intact.

5. Comments

5.1 The MybrumTV Site allows the submission of comments and other communications submitted by you and other users ("Comments") and the hosting, sharing, and/or publishing of such Comments. MybrumTV does not guarantee any confidentiality with respect to any Comments.

5.2 You shall be solely responsible for your own Comments and the consequences of posting or publishing them. In connection with Comments, you hereby warrant that: (i) you own or have any necessary licenses, rights, consents, and permissions to submit your Comments to the Site and to allow use of the Comments as contemplated by the Site and these Terms and Conditions; and (ii) you waive any moral rights in your Comments for the purposes of its submission and (iii) your Comments do not and shall not infringe the rights of any third party.

5.3 You will retain ownership of all intellectual property rights that you own in your Comments. However, by submitting the Comments to the Site, you hereby grant MybrumTV a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, and display the Comments in connection with the Site and MybrumTV’s (and its successor's) business, in any and all media now known or hereafter devised. You also hereby grant each User of the Site a non-exclusive license to access your Comments through the Site, and to use, reproduce, distribute, prepare derivative works of, display and perform such Comments through the Site and under these Terms and Conditions. The license granted by you in relation to the Comments terminates when you remove or delete a User Post from the Site.

5.4 In relation to your Comments, you warrant that you will not: (i) submit material that is unlawful, obscene, defamatory, libelous, pornographic, abusive, racially or ethnically offensive, or criminal, or that may give rise to civil liability, violate any law, or is otherwise inappropriate; (ii) submit material that is copyrighted, protected by confidentiality obligations or subject to other third party rights, without the required permissions and consents to post the material and to grant MybrumTV the rights granted herein; (iii) post advertisements or solicitations of business: (iv) pretend to be another person.

5.5 MybrumTV does not endorse and has no control over the Comments. Comments are not necessarily reviewed by MybrumTV prior to posting and Comments do not necessarily reflect the opinions or policies of MybrumT . MybrumTV does not endorse any opinion, recommendation, or advice contained in any Comments and disclaims any and all liability in connection with Comments. MybrumTV will remove all Comments if notified that such Comments infringe on a third party’s rights. MybrumTV reserves the right to remove Comments without notice and the right to terminate a User's access to the Site if any User is considered to be a repeat infringer (in MybrumTV’s sole discretion). MybrumTV shall have sole discretion to decide whether a User Post is appropriate and complies with these Terms and Conditions and MybrumTV may remove such Comments and/or terminate a User's account for uploading any material that violates these Terms and Conditions at any time, without prior notice.

5.6 You understand and acknowledge that you may be exposed to Comments that are inaccurate, offensive, indecent, or objectionable, and you hereby waive any legal or equitable rights or remedies you have or may have against MybrumTV with respect thereto. MybrumTV makes no warranties, express or implied, as to the Comments or to the accuracy and reliability of the same or any material or information that you transmit to other Users.

6. Disclaimer

MybrumTV and its officers, employees or agents are not and shall not be responsible for any incorrect or inaccurate Content posted on the Site. MybrumTV is not responsible for the Content, accuracy or opinions expressed on websites accessed through links contained on or posted on the Site, and such websites are in no way investigated, monitored or checked for accuracy or completeness by MybrumTV. MybrumTV takes no responsibility for third party advertisements which are posted on the Site and it does not accept any responsibility for the goods or services provided by its advertisers.

The Site is provided "AS-IS" and as available and MybrumTV does not warrant of timely, secure, error- and interruption-free provision of the Site. MybrumTV expressly disclaims any warranty of fitness for a particular purpose or non-infringement. The exclusion of warranties does not affect your right of withdrawal.
MybrumTV nor its officers, employees or agents be liable for any direct, indirect, consequential, incidental or consequential damages resulting from (i) personal injury or property damage (ii) unauthorized access or use of the Site, (iii) any bugs viruses or the like which may be transmitted to or through the Site by any third party, or (iv) any errors or omissions in any Content or for any loss or damage of any kind incurred as a result of your use of the Site to the fullest extent permitted by law in the applicable jurisdiction.

The Site is controlled and offered by MybrumTV from its facilities in England and MybrumTV makes no representations that the Site is appropriate or available for use in other locations.

7. Indemnity

You agree to defend, indemnify and hold harmless MybrumTV, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms and Conditions; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your Comments caused damage to a third party. This indemnity will survive these Terms and Conditions and your use of the Site.

8. Third Parties
We would like to share your information with organisations who are our business partners. They may contact you by mail or telephone to let you know about any goods, services or promotions, which may be of interest to you. We will always give you an option to opt out at the point where you give us your details. We will never supply your information to a third party for marketing purposes if you tell us not to.
You may also exercise your right to opt out of the use of your information being supplied to a third party, for marketing purposes at any time, by contacting us.

9. General

These Terms and Conditions shall be governed by the laws of England and Wales. Any claim or dispute between you and MybrumT arising from the Site shall be decided exclusively by the courts of England and Wales. If any provision of these Terms and Conditions is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. No waiver of any term of this these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and MybrumTV’s failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision. MybrumTV reserves the right to amend these Terms and Conditions at any time and without notice, and it is your responsibility to review these Terms and Conditions for any changes. These Terms and Conditions, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by MybrumTV without restriction.
